AN ORDINANCE ACCEPTING THE ROADS OF THE MEADOWS AND THE MEADOWS PHASE II SUBDIVISIONS AS PARISH ROADS

 

WHEREAS, under La. R.S. 33:1236 (2)(a) parish governing authorities have been granted the power “To regulate the proportion and direction, the making and repairing of the roads, bridges, causeways, dykes, dams, levees and highways when, in the opinion of the police jury, such work will further the best interests of the Parish and the Parish road system;”

 

AND WHEREAS, the Washington Parish Government has the equipment, personnel and capabilities of providing double bituminous surface treatment to Parish roads;  

 

AND WHEREAS, the owner of the roads located in The Meadows and The Meadows Phase II Subdivisions has agreed to pay the costs of materials necessary to bring the roads in compliance with Parish standards and for application of  double bituminous surface treatment;

 

AND WHEREAS, the roads of The Meadows and The Meadows Phase II Subdivisions would be in substantial compliance with Parish regulations upon completion of the above;

 

BE IT ORDAINED, the Washington Parish Government accepts the roads of The Meadows and The Meadows Phase II Subdivisions, namely:  Pelican Road, Falcon Road, Blue Bird Road, Skylark Road, Sam Smith Road, Finch Road, A Road, B Road, C Road, D Road, E Road, F Road and G Road, which roads named A-G have been renamed Canary Lane, Eagle Lane, Sandpiper Lane, Nightingale Lane and Love Bird Lane, all as shown on the survey plats of The Meadows by Land Surveying, Inc. dated May 21, 2003, Drawing No. 10,148, of record in Plat Cabinet 3, Entry 77, The Meadows Phase II, by Land Surveying, Inc., dated March 5, 2004, Drawing No. 10,583, of record in Plat Cabinet 3, Entry 78, and Re-Subdivision Map of Parcel 78, The Meadows Phase II, by Land Surveying, Inc. dated June 16, 2005, Drawing No. 11,327, of record in Plat Cabinet __3__, Entry _79__, Washington Parish, Louisiana, as public roads upon dedication of the roads by the owner in a manner acceptable to the Washington Parish Government upon compliance with the following conditions:

 

1.             The owner depositing with the Washington Parish Government the sum of $126,516.93 to be used for costs of materials for the roads;

2.             The execution of an agreement between the owner and the Washington Parish Government, wherein the owner will pay the costs of materials and the Parish will provide the labor and equipment for the roads;

3.             Further, in the event that the roads are not completed by the end of 2011, then the owner will pay any additional costs for materials that the Parish may incur in 2012 in excess of the 2011 costs, the time for construction of the roads will be done in a reasonable manner at the discretion of the Washington Parish Government.  

 

                        The above and foregoing having been submitted to a vote, the vote thereupon

resulted as follows:
